Terms of Service

These Terms of Service ("Terms") govern your use of HOLY HIBACHI's ("HOLY HIBACHI," "we," "us," "our") catering services and the website at https://www.holyhibachi.com. By submitting a quote request or confirming a booking, you agree to these Terms.

1. Services

HOLY HIBACHI provides live hibachi catering — a professional chef brings the grill, fresh proteins, vegetables, and the live show to the event location you specify. Services include the cooking equipment, food, table-side entertainment, and the included perks listed in your final quote.

2. Booking and Confirmation

  • Bookings are confirmed only after we have received your deposit and you have received a written confirmation email from us. A submitted quote request is not a confirmed booking.
  • You are responsible for providing accurate event details (date, time, address, guest count, dietary restrictions). Last-minute changes may incur additional fees.
  • Minimum booking total is $1,000. Bookings below this threshold are not accepted.

3. Deposit and Payment

  • A non-refundable deposit of 10% of the total booking (minimum $100) is required within 24 hours of submitting your booking request to confirm your date.
  • If the deposit is not received within 24 hours, we may release your reserved date to another customer.
  • The remaining balance is due on or before the event day, prior to the start of service.
  • Accepted payment methods are listed at time of booking. We do not store credit card numbers on our servers.

4. Cancellation and Rescheduling

  • 7+ days before event: deposit may be applied to a rescheduled date within 90 days, subject to availability. Deposit is otherwise forfeited.
  • 3–6 days before event: 50% of total booking is owed.
  • Less than 72 hours before event: 100% of total booking is owed.
  • Acts of nature (severe weather, natural disasters) and government-mandated closures will be handled in good faith with the customer; we will work with you to reschedule without penalty.

5. Travel Fee

The first 30 miles from our Brooklyn central kitchen are included free. Beyond 30 miles, a $30 base travel fee plus $1 per additional mile applies (tolls included). Travel distance is auto-calculated from the event address you provide. For events more than 100 miles from Brooklyn, please contact us for a custom quote.

6. Allergies and Dietary Restrictions

  • You must disclose all known allergies and dietary restrictions at time of booking.
  • We prepare food in a shared kitchen environment where shellfish, soy, gluten, dairy, eggs, and other allergens are present. While we take precautions, we cannot guarantee an allergen-free environment.
  • Customers with severe food allergies acknowledge the risk and assume responsibility for their own safety. HOLY HIBACHI is not liable for allergic reactions caused by undisclosed allergies or cross-contact.

7. Premium / House Special Items

House Special items (e.g., Foie Gras, Japanese A5 Kobe Beef Striploin, A5 Miyazaki Filet Mignon) are subject to availability. Selecting these items at booking time does not guarantee delivery; our chef will contact you to confirm sourcing prior to your event. If a House Special item cannot be sourced, you will receive a full refund for that item or be offered a substitute of equal value.

8. Event Setup and Conduct

  • You are responsible for providing an appropriate flat surface, adequate ventilation, and access to power and water (when applicable) at the event location.
  • Open-flame cooking is involved. You must ensure the event area is clear of obstructions, low-hanging materials, and small children during the cook.
  • You must ensure all guests treat our staff with respect. We reserve the right to end service early in cases of abusive behavior, with no refund.

9. Property Damage

HOLY HIBACHI is not responsible for property damage that may occur during the event, including grill heat marks on patios, smoke discoloration, or damage to lawn furniture. You are responsible for selecting an appropriate cook location.

10. Photography and Marketing

Our chef may take photos or short videos of the event for marketing purposes (website gallery, social media). If you do not consent to this, please notify us in writing at booking time. We will respect your request and not photograph identifiable guests.

11. Limitation of Liability

HOLY HIBACHI's liability for any claim arising from your event is limited to the total amount paid for the booking. We are not liable for indirect, consequential, or incidental damages, including lost profits, lost business, or emotional distress.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of New York. Any disputes will be resolved in the state or federal courts located in Kings County, New York.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by a notice on our website and, if you have an upcoming booking, by email. The "Effective date" at the top reflects the most recent update.
